Disqualifying Factors for Utah CFP

Our State has set forth a set of guidelines that may affect your eligability to obtain a Utah concealed carry permit.
1. You must be at least 21 years of age.
2. Be a legal U.S. citizen.
3. Unless the record has been expunged you may not obtain a concealed carry permit if you have been convicted of/or been on probation for a;

Juvenille record
Felony within last 7 years
Violent Foleny within last 10 years

Adult record
Class B and C misdemeaner within the last 3 years
Class A misdemeaner within the last 5 years
D.U.I. or Alcohol related reckless within the last 6 years
Domestic violence ever
Sexual offense ever
Felony offense ever
Currently under restrictions from a restraining order
Are currently adjucated by a court as mentally incompetent
Crime of moral turpitude which include:

Murder, Voluntary Manslaughter, Homicide by Reckless Conduct, Involuntary Manslaughter w/ Reckless Disregard, Attempted Murder, Kidnapping, Mayhem, Assault, Attempted Murder, Carrying a Concealed Weapon, Assault w/ a Deadly Weapon, Interfering w/ a Law Enforcement Officer, Obstruction of Justice, Assault Against a Peace Officer, Attempted Arson, Blackmail, Forgery, Forged Prescription, Making False Statements, Robbery, Embezzlement, Larceny, Theft, Grand theft, Petty Theft, Receiving Stolen Property, Concealing Assets in Bankruptcy, Encumbering Mortgaged Property w/ Intent to Defraud, Fraudulently Issuing Check w/ Insufficient Funds, Fraudulently Issuing Worthless Check, Illegal use of ATM or Credit Card, Passing Forged Instrument, Attempted Fraud, Using Mails to Defraud, Making False Statements in Acquisition of Firearm, Securities Fraud, Welfare Fraud, Transporting Stolen Property, Obtaining Money by False Pretenses, Bribery, Malicious Trespass, Falsely Issuing a Narcotic Prescription, Offering a Bribe, Making Passing or Possessing Counterfeit Coins, Conspiracy to Violate IRS Laws, Securities Fraud, Counterfeiting, Smuggling Merchandise, Impersonating Federal Officer, Harboring a Fugitive, Using False Names & Addresses to Violate Postal Laws, Selling False Counterfeit Immigration Documents, False Statements to Obtain a Passport, False Statements in LPR Application, Perjury, Theft from U.S. Mail, Taking Kickbacks, Receiving Funds by False Statements, Trafficking in Narcotics, Failing to Report Income, Union Official Unlawfully Accepting a Loan, Kickbacks on Government Contracts, Selective Service, Falsely Representing Social Security Number, False Statements for Unemployment Benefits

If you have convictions for any of these even if expunged on your records we recomend contacting BCI at (801-965-4445) or http://bci.utah.gov/contact.html before applying for a permit. BCI will be able to tell you whether or not one of these offenses may constitute denial of your application and walk you through the expungement process if it will help. BCI will search ALL CRIMINAL RECORDS when you apply including out of state, juvenille, and expunged.
